The terms for the website and interest list. Product participation is addressed before enrollment.
1. Agreement
These terms describe the website and interest list. Product participation will require its own invitation and applicable consent process. Please also read the Privacy Policy.
2. Eligibility
Adults aged 18 or older may register their own interest. A parent or guardian may use their own contact details to express interest for a prospective participant aged 13–17. This is not teen enrollment or completed participant consent; invitations will provide the participation and consent steps before enrollment. There is no registration route for children under 13.
3. The beta
The website records interest in a future invitation. Joining the list does not enroll you in the product or promise an invitation date. Invitations will explain supported features and participation expectations before you accept.
4. The score
- The Performance Equity Score™ is a measurement of verified effort over time, on a 0 to 999 scale. It is not money, credit, or a financial instrument. It carries no cash value and is not redeemable.
- The website provides a conditional starting-point estimate from your answers. The supported product release must confirm eligible history and explain its scoring and calibration rules before participation.
- The score is yours to hold and to share. Nothing here obligates any institution to honor it.
- Performance Equity Units (PEU) are a separate, future layer. They are not offered under these terms.
5. Connected devices and venues
Joining this list does not connect a device. Invitations will identify supported devices, activities, connections, and data permissions before participation.
6. Acceptable use
Provide accurate information when registering interest or contacting us. Do not misuse the website or submit information on another person’s behalf without authority. Product account and verification rules will be provided before participation.
7. Your account and your data
You own your record. How we collect, use, and share data is in the Privacy Policy. Joining the interest list does not open a product account or connect a platform. Contact us for questions about your list information.
8. Intellectual property
The site, the service, and the verification architecture belong to Performance Equity Inc. A patent application on the architecture is pending. Performance Equity™, Performance Equity Score™, PES™, Proof of effort™, Honor your effort™ and Let your sweat answer™ are trademarks of Performance Equity Inc. Effort is opportunity™ is a trademark of Performance Equity Foundation Inc. You may not use them without written permission.
9. Future cards and programs
Card illustrations and possible institutional uses describe future plans. They do not establish an issuer, payment relationship, participating venue, funded benefit, or a right to support.
10. No medical advice
Performance Equity measures verified effort. It is not medical advice, not a diagnosis, and not a training program. Talk to a professional before you change how you train.
11. Disclaimers
The service is provided as is and as available during the beta. We do not warrant that it will be uninterrupted or error-free, that every session will verify, or that the score will be honored by anyone.
12. Limitation of liability
To the extent the law allows, Performance Equity Inc. is not liable for indirect, incidental, special, or consequential damages, or for any amount above what you paid us in the twelve months before the claim (which, for a free score, is zero).
13. Ending the relationship
Contact us to withdraw interest or request removal of your list information. The Privacy Policy states the retention and deletion procedure. Product account closure and enforcement belong to the participation terms supplied before enrollment.
14. Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes are resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
15. Changes
When these terms change, the effective date changes with them. Material changes reach list members and participants by email before they take effect. Continued use after the effective date is acceptance.
